Patent Search Committee
This Committee will examine topics, and be a resource for information related to patent searching. It will define and publicize different categories of patent searches (e.g., patentability, validity, infringement, right to practice), analyze techniques and sources for doing such searches, and promote best practices related to patent searching. The Committee will provide feedback on the USPTO’s efforts to develop new search templates or guidelines to assist in searching specific patent classes and sub-classes. It will examine searching in crowded art areas that are difficult to search, as well as in emerging new technologies where an abundance of non-patented prior art may be present. In addition, the Committee will review the availability of search-related information from foreign countries and will work with IPO’s International Patent Law and Practice and U.S. Patent Office Practice committees and the IPO Industry Trilateral Group to foster dialog about subjects related to patent searching. It will develop a proposal for standardizing nomenclature in new technology areas where standard definitions do not exist — such as in the fields of business methods, software, and nanotechnology. The Committee will work with IPO’s Software and Business Methods committee on this issue. It will propose ways to educate IPO members, and in particular, small businesses, about subjects related to patent searching.
